Terms of Service

These terms govern use of QuestBox across the website, web application, and mobile applications. They are written for the adults and organizations responsible for each workspace.

QuestBox assists with assessment creation and review, but AI output may be wrong. A qualified adult remains responsible for every assessment, answer key, mark, and decision. QuestBox is not high-stakes examination software.

Agreement and scope

These Terms of Service (Terms) form an agreement between you and QuestBox and govern the websites, web applications, mobile applications, software, content, and related services we provide (together, the Services). By creating an account, accepting an invitation, buying a plan, or otherwise using the Services, you agree to these Terms and the Privacy Policy.

QuestBox is an unincorporated online service operated by an individual based in Singapore. References to “QuestBox,” “we,” “us,” or “our” mean that individual operator. Public business contact details are provided in section 18.

If you use the Services for a school, business, tutoring organization, or other entity (Organization), you agree on its behalf and confirm that you have authority to bind it. “You” then means both you and the Organization. An order form, data processing agreement, or other written agreement with QuestBox may add to these Terms; that agreement controls if there is a direct conflict.

Eligibility and authority

You must be at least 18 years old, have reached the age of legal majority where you live, or use the Services under a valid agreement made by an authorized adult or Organization. Learners do not need and must not create adult QuestBox accounts.

Learners aged 8 and older may complete activities assigned or supervised by a parent, guardian, teacher, or school. In Singapore, a learner below 13 must have parent or guardian consent. Any higher minimum age or consent requirement in the learner’s location continues to apply.

You may use the Services only where permitted by law. You represent that you are not prohibited from receiving the Services under applicable trade sanctions or export-control laws. Consumer rights that cannot lawfully be waived remain in effect.

Accounts and organizations

You must provide accurate account information, keep credentials confidential, and promptly update information that changes. You are responsible for activity under your account and for using reasonable security measures on every device that can access it. Tell us promptly if you suspect compromise.

Organization owners and administrators control membership, roles, billing, content, exports, retention, and deletion. Your access to an Organization may end when that Organization changes your role or membership. If an Organization controls your account, its administrator may access and manage content associated with that workspace as permitted by the Services and applicable law.

Accounts may not be sold, shared outside an Organization’s authorized users, created by automated means, or used to evade plan limits or enforcement.

License and acceptable use

Subject to these Terms, QuestBox grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Services for lawful educational and internal organizational purposes during your subscription or permitted free use.

You must not, and must not help anyone else to:

  • break the law, violate another person’s rights, or process learner data without authority;
  • upload malware, unlawful material, sexual or exploitative content involving minors, or content that promotes serious harm;
  • probe, disrupt, overload, bypass, or defeat security, authentication, access controls, rate limits, quotas, or content safeguards;
  • access another tenant, account, assessment, or learner record without authorization;
  • scrape, crawl, bulk-extract, or use automated means except through interfaces we expressly provide;
  • reverse engineer, decompile, modify, copy, resell, lease, sublicense, or create a competing service from the Services, except where applicable law expressly permits and cannot be waived;
  • misrepresent AI output as verified human work, use the Services for unlawful surveillance or discrimination, or make high-stakes decisions without appropriate human review; or
  • remove legal, copyright, attribution, or security notices.

Your content

You retain ownership of documents, images, questions, rubrics, answers, branding, and other material you submit or direct us to process (Your Content). You grant QuestBox and its service providers a worldwide, non-exclusive, royalty-free license to host, copy, transmit, transform, display, and otherwise process Your Content only as needed to provide, secure, support, and improve the Services, comply with your instructions, and meet legal obligations.

You represent that you have all rights and permissions needed for Your Content and its use through the Services, including copyright permissions and authority to process personal data. You are responsible for the accuracy, legality, quality, and classroom suitability of Your Content and for maintaining any source copy you need.

You should not upload sensitive personal data, confidential examination material, regulated records, or third-party content unless your Organization has approved the use and has an appropriate legal basis and agreement in place.

AI features and grading

The Services may use AI to transcribe, generate, classify, translate, critique, grade, or summarize content. AI output is probabilistic and may be false, incomplete, biased, offensive, unsafe, or unsuitable. Similar output may be produced for other users.

You must review all questions, citations, answer keys, rubrics, translations, feedback, and grades before relying on them. QuestBox does not guarantee that output is unique, factually correct, pedagogically appropriate, or free of third-party rights. The Services are not a substitute for a teacher’s judgment, professional advice, safeguarding duties, or legally required accommodations.

QuestBox is intended for practice, homework, revision, formative assessment, tutoring, and ordinary classroom assessment. Do not use it as the sole basis for admissions, certification, discipline, employment, medical or psychological conclusions, special-education placement, or another legal or similarly significant decision.

If you connect a third-party AI provider or bring your own API key, you authorize QuestBox to send the relevant inputs to that provider. You are responsible for the provider account, charges, configuration, usage rights, and separate provider terms. QuestBox does not guarantee availability or behaviour of a provider you select.

Learners, children, and schools

The adult or Organization administering an assessment is responsible for learners’ participation. This includes giving legally required notices, obtaining parental or guardian consent or another lawful basis, limiting data collection, responding to rights requests, supervising use, and complying with education, child-privacy, accessibility, and safeguarding laws.

Learners should use a nickname or classroom identifier rather than unnecessary identifying information. You must not ask a learner to place sensitive data in an answer unless it is genuinely required, lawful, and covered by appropriate safeguards.

If FERPA or another student-record law applies, the Organization determines QuestBox’s permitted educational purpose and direct-control requirements. Institutional customers should put a data processing agreement or school privacy addendum in place before production use where required.

Sharing and public content

The Services may let you publish a test, create a share link or join code, email an invitation, list an organization publicly, or export material. You control those choices and are responsible for intended recipients, access settings, and revoking links that should no longer work.

Do not publish personal data, confidential content, misleading claims, unlawful material, or content that infringes rights. We may investigate reports and restrict, unpublish, or remove content or accounts when reasonably necessary to protect users, comply with law, or enforce these Terms. We do not endorse user-published content.

Plans, billing, and taxes

Plan prices, features, usage credits, storage, seats, and other limits are shown at purchase and may vary by market or agreement. Unless stated otherwise, paid plans renew automatically at the end of each billing period until cancelled. You authorize the payment provider to charge the payment method on file, including applicable taxes.

You may cancel renewal through the billing interface or the app store through which you subscribed. Cancellation takes effect at the end of the paid period unless law or the purchase terms require otherwise. Fees already paid are non-refundable except where the purchase terms, our written refund policy, or applicable law requires a refund. App-store purchases, refunds, and billing disputes are also governed by that store’s terms.

If payment fails, we may retry the charge, restrict paid features, or move the workspace to an available lower tier after reasonable notice. Downgrades may reduce limits or availability of content and features. We will provide a reasonable opportunity to export or manage affected data where applicable.

Platform AI credits measure eligible operations and have no cash value. Unused credits do not roll over unless the plan expressly says so. Bring-your-own-key usage may avoid platform AI-credit limits, but the provider may charge you directly and QuestBox plan limits for seats, storage, and features still apply.

Third-party services

The Services depend on or link to third-party services, including hosting, databases, storage, email, payments, AI providers, bot protection, push notifications, and app stores. Their terms and privacy policies may apply to your direct relationship with them. QuestBox is not responsible for a third party’s service, content, availability, or independent acts, but remains responsible for its own obligations under applicable law.

You must comply with applicable network, device, app-store, AI-provider, and payment-provider terms while using the Services.

QuestBox intellectual property

QuestBox and its licensors own the Services, software, design, trademarks, documentation, and other materials we provide, excluding Your Content. These Terms grant only the limited right in section 4 and do not transfer ownership.

If you send feedback or suggestions, you grant QuestBox a perpetual, worldwide, irrevocable, royalty-free right to use them without restriction or compensation, provided we do not identify you publicly without permission.

Suspension and termination

You may stop using the Services at any time. You may permanently delete your account using the in-app or web deletion controls. Your login identity is disabled and anonymized immediately. Content created for a shared Organization remains under that Organization’s control without your personal identity. If you are the sole owner of a shared Organization, you must transfer ownership or request deletion of that Organization first.

An Organization owner may request workspace deletion through available controls or by contacting us. Workspace deletion is subject to a 30-day cancellation period, after which the workspace and associated data are permanently purged as described in the Privacy Policy.

We may suspend, restrict, or terminate access if you materially breach these Terms, create security or legal risk, fail to pay, exceed authorized limits, or if continued service is prohibited by law. Where reasonable, we will give notice and an opportunity to cure. We may act immediately where needed to protect learners, other users, data, or the Services.

Sections that by their nature should survive termination do survive, including ownership, payment obligations, disclaimers, liability limits, indemnity, dispute provisions, and terms concerning retained data.

Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” QuestBox disclaims implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation.

We do not warrant that the Services or AI output will meet every curriculum, policy, legal, accessibility, or assessment requirement; that citations or grading will always be correct; that third-party services will remain available; or that data will never be lost or accessed without authorization. Nothing in these Terms excludes a warranty or remedy that applicable consumer law does not allow us to exclude.

Liability and indemnity

To the maximum extent permitted by law, neither QuestBox nor its suppliers will be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, goodwill, data, business opportunity, or procurement of substitute services, arising from or related to the Services, even if advised that such loss was possible.

To the maximum extent permitted by law, QuestBox’s total aggregate liability arising from the Services or these Terms will not exceed the greater of (a) the amount you paid QuestBox for the Services during the 12 months before the event giving rise to the claim or (b) USD 100. These limits do not apply to liability that cannot lawfully be limited, including where applicable fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or non-waivable consumer rights.

If you use the Services for an Organization, the Organization will defend and indemnify QuestBox and its personnel against third-party claims, losses, and reasonable costs arising from Your Content, the Organization’s instructions, its assessments or learner relationships, or its unlawful use of the Services, except to the extent caused by QuestBox’s breach, negligence, or misconduct. This paragraph does not apply to individual consumers where prohibited by law.

Disputes and governing rules

Before filing a formal claim, please email hello@questbox.in with a description of the issue and requested resolution. We will try in good faith to resolve it informally.

These Terms are governed by the laws of Singapore, and the courts of Singapore have non-exclusive jurisdiction over disputes, except that mandatory consumer, privacy, employment, education, or other local laws and forums continue to apply where they cannot be varied by contract. Nothing in these Terms prevents either party from seeking urgent injunctive relief or using a regulator, consumer tribunal, or small-claims process available under applicable law.

Mobile app-store terms

Your use of a mobile app is also subject to the store’s usage rules. The app is licensed, not sold. If you obtained the iOS app through Apple’s App Store, Apple’s then-current Standard Licensed Application End User License Agreement applies to the app license unless QuestBox supplies a valid custom EULA through App Store Connect. These service Terms govern your QuestBox account and hosted Services.

Apple and Google are not responsible for the QuestBox Services, content, maintenance, support, or claims about the Services. QuestBox, not an app store, is responsible for addressing product, privacy, regulatory, and intellectual-property claims concerning the Services, subject to these Terms and applicable law. Any rights an app-store provider has under its own terms remain unaffected.

Changes to the Services or terms

We may improve, add, remove, or discontinue features and may update these Terms for legal, security, commercial, or product reasons. We will post updated Terms with a new effective date and give additional notice of material changes where required. If you do not agree to updated Terms, stop using the Services and cancel before they take effect. Continued use after the effective date constitutes acceptance where permitted by law.

General terms and contact

Neither party is liable for delay or failure caused by events beyond reasonable control, except payment obligations. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, financing, or sale of the relevant business, subject to applicable law. No waiver is continuing. If a provision is unenforceable, it will be modified only as much as necessary and the rest remains effective. These Terms and incorporated agreements are the entire agreement about their subject matter.
